Understanding the Kansas TR-65 form is essential for residents or businesses that are currently outside the state but intend to register a vehicle in Kansas. This form plays a crucial role in verifying a vehicle's identification number (VIN) when the vehicle and its owner are not physically present in Kansas. Its requirement stems from the necessity to authenticate the ownership document or title issued by another jurisdiction, ensuring the VIN on the title matches the VIN on the vehicle. Designed to accommodate certain qualifying reasons for a Kansas resident or business to be temporarily out of state, such as active military duty, attending an educational institution, applying for Kansas apportioned registration, or other temporary stays outside Kansas, this form allows the continuation of the vehicle registration process in absentia of the owner. The form demands the complete and truthful declaration from the owner regarding the vehicle's status and requires a law enforcement officer's verification of the VIN against the non-Kansas title or ownership document and the vehicle itself. This entails a thorough inspection for any discrepancies, alterations, or signs of tampering, alongside a check against national databases for stolen vehicles, ensuring the integrity of the vehicle's identification before it can be legally registered in Kansas. Notably, the completion of this process, through the TR-65 form or the subsequent MVE-1 form upon the vehicle's return to Kansas, is mandated by state law (KSA 8-116a) and serves as a testament to Kansas's commitment to vehicle ownership verification and fraud prevention. Such diligence ensures that residents or businesses temporarily away from Kansas can smoothly transition their vehicle registration without unnecessary hurdles, provided all requirements are met and documented accurately on the form.

Previous versions of this form are subject to requirements listed herein.

VIN VERIFICATION WHEN KANSAS RESIDENT TEMPORARY LOCATED IN ANOTHER STATE

Kansas law (KSA 8-116a) requires before an application for a Kansas title and/or registration can be accepted for a vehicle surrendering a title issued by another jurisdiction (or purchased on a bill of sale, if applicable) as proof of ownership, the vehicle and the non-Kansas title or ownership document must be inspected to ensure that vehicle identification number shown on the non-Kansas title is genuine and agrees with the identification number on the vehicle and a Motor Vehicle Examination Certificate (MVE-1 Form) must be completed by the Kansas Highway Patrol or their designee.

When a Kansas resident/business is making application for Kansas title and/or registration and has selected reason 1, 2 or 3 below, this form may be used in lieu of the MVE-1 form. If reason 4 is selected, this TR-65 form will only be accepted to submit the application for title and/or registration. Upon returning the vehicle to Kansas an MVE-1 form must be obtained from the Kansas Highway Patrol or their designee. When reason 4 is selected, renewing the registration for the vehicle with a pending title application awaiting the MVE-1 form must be pre-approved by the division and can only be approved one time. The Titles & Registrations Bureau must receive the MVE-1 form before the certificate of title will be issued.

WHO QUALIFIES TO USE THE TR-65 FORM?

To qualify for an Out-of-State VIN Verification in lieu of the MVE-1 the Kansas resident/business must meet one of the following:

1.Resident is on active military duty stationed in another state, or;

2.Resident is attending a college, university or school in another state as a full time student, or;

3.(Resident or Business) Any out-of-state title application for Kansas apportioned registration that requires a VIN inspection (MVE-1) and the vehicle is not in Kansas, or;

4.Resident or business vehicle is “temporarily” in another state for reasonable cause (i.e.-working on a short term basis, seasonal resident, etc.).

INSTRUCTIONS FOR COMPLETION OF “OWNER DECLARATION” SECTION

The vehicle owner must check the applicable box regarding the reason the vehicle is out-of-state and provide a brief explanation regarding the circumstances. If the resident/business vehicle is “temporarilyout-of-state (reason 4 above), the owner must indicate the approximate date of return to Kansas and the reason for being out-of-state in the spaces provided.

The owner must print their name and address in the appropriate areas. The owner’s legal signature is required certifying that the vehicle is temporarily located out-of-state due to one of the qualifying reasons and the information is true and correct.

INSTRUCTIONS FOR COMPLETION OF “VIN VERIFICATION” SECTION

NOTICE - VIN VERIFICATION MUST BE PERFORMED BY A LAW ENFORCEMENT OFFICER

The law enforcement officer should examine the out-of-state title/ownership document for authenticity. The out-of-state title/ownership document must be free of erasures, whiteout, or altered data. (A faxed copy of the front and back of the title from the lien holder or lessor will be acceptable.)

The law enforcement officer must examine the public VIN on the vehicle, verifying there is no evidence of tampering with the VIN plate or attachments, compare the public identification number on the vehicle to the VIN number on the title/ownership document and record the VIN in the spaces provided on the form. Any discrepancies must be noted in the “Remarks” section. Additionally, the officer must provide the vehicle and title information in the spaces provided. Mark the appropriate box concerning if the title has been branded/labeled by the jurisdiction that issued the certificate. Check the appropriate box regarding whether the “supporting documents” (i.e.- title/ownership documents) agrees/disagrees with VIN, etc. The “Remarks” section may be used to record any other information the officer determines may be of importance.

All vehicle identification numbers discovered during the verification process must be checked through NCIC. If a stolen record is received the officer should respond according to the officer’s agency/department policy and/or state or local laws.

The law enforcement officer's signature will certify that he/she is a law enforcement officer and has physically examined the vehicle and title described on the ownership documents and the information is true and correct to the best of his/her knowledge, and verify that no stolen record was found in the Federal or States vehicle files (NCIC).

There will be no fee collected for the State of Kansas on an out-of-state VIN verification utilizing this form.

POSSIBLE ADDITIONAL REQUIREMENTS

If during the VIN verification procedure, a discrepancy is determined with either the vehicle identification number or the title document further documentation may be required by the State of Kansas.

Who can use the TR-65 Form?

The Kansas Resident/Business Out of State VIN Verification TR-65 Form is available for any Kansas resident or business who owns a vehicle that is currently located outside of Kansas due to specific reasons. Eligible individuals include those on active military duty stationed out-of-state, residents attending an out-of-state college, university, or school as a full-time student, applications for Kansas apportioned registration, and residents or businesses with vehicles temporarily out of Kansas for a reasonable cause.

What is the purpose of the TR-65 Form?

The TR-65 Form is used to verify a vehicle's identification number (VIN) when the vehicle and the owner are out-of-state. It serves as an alternative to the Motor Vehicle Examination Certificate (MVE-1 Form) usually required for vehicles entering Kansas with a title issued by another jurisdiction. This ensures the VIN on the non-Kansas title matches the vehicle's identification number.

How does the VIN verification process work with the TR-65 Form?

VIN verification must be conducted by a law enforcement officer. The officer examines the out-of-state title for authenticity and the vehicle for any signs of VIN tampering. They then verify that the VIN on the vehicle matches the one on the title or ownership document. Any discrepancy is noted, and the vehicle identification numbers discovered during the process are checked through the NCIC to ensure the vehicle is not stolen.

Are there any fees for using the TR-65 Form?

No, the State of Kansas does not collect a fee for the out-of-state VIN verification conducted using the TR-65 Form.

What should be done if there are discrepancies or issues found during the VIN verification?

If discrepancies are found during the VIN verification process, additional documentation may be required by the State of Kansas. It's important to address these discrepancies promptly to avoid delays in the title and/or registration process.

What documents are required to complete the TR-65 Form?

The owner declaration section must be completed by the vehicle owner, indicating the reason the vehicle is located out-of-state. The VIN verification section must be completed by a law enforcement officer, who will also need to inspect the vehicle and the title or ownership document. A clear and authentic out-of-state title or ownership document, free of erasures or alterations, is necessary for the verification process.

Can the TR-65 Form be submitted electronically?

The specific submission process for the TR-65 Form may vary. It's essential to follow the instructions provided by the Kansas Division of Vehicles or consult directly with their office to ensure the form is submitted correctly and in the accepted format.

What happens after submitting the TR-65 Form?

Upon submission and approval of the TR-65 Form, the vehicle's VIN is considered verified for the purposes of titling and/or registering the vehicle in Kansas. If the vehicle was "temporarily" out of Kansas, an MVE-1 form must be obtained upon the vehicle's return to Kansas to complete the title and registration process.

Is it possible to renew vehicle registration using the TR-65 Form?

When a vehicle is temporarily out of Kansas, and reason 4 is selected on the TR-65 Form, renewal of the vehicle registration with a pending title application awaiting the MVE-1 Form is possible but must be pre-approved by the Division. This can only be approved one time and under specific circumstances.

Who can I contact for questions or more information about the TR-65 Form?

For any questions or additional information regarding the TR-65 Form, individuals should contact the Kansas Division of Vehicles Titles and Registrations Bureau. Assistance is available by calling their office or sending correspondence to their address in Topeka, Kansas.

Common mistakes

Filling out the Kansas TR-65 form, which is crucial for vehicle identification number (VIN) verification for Kansas residents or businesses with vehicles located out-of-state, can sometimes be a complex process. Errors on this form can lead to delays or rejection of the application for a Kansas title and/or registration. Here are the 10 common mistakes to avoid:

  1. Not checking the correct qualifying reason for the vehicle being out-of-state on Part I – OWNER DECLARATION. It is imperative to select the appropriate reason why the vehicle is located outside of Kansas to ensure the form is processed correctly.
  2. Failure to provide a detailed explanation in the space provided under the checked qualifying reason. A brief yet detailed explanation helps clarify the situation and supports the application process.
  3. Forgetting to fill out the date the vehicle will be returned to Kansas, especially when the vehicle is out of state temporarily. This date helps establish the timeframe for the vehicle’s return and subsequent inspection requirements.
  4. Omitting the owner’s printed name and signature, which are essential to certify the declaration in Part I. The form requires the owner's acknowledgment, making this a crucial step.
  5. Entering incorrect addresses for either the out-of-state or Kansas residences/businesses. Accurate addresses are necessary for proper processing and communication.
  6. In Part II – VIN VERIFICATION, allowing anyone other than a law enforcement officer to complete the section. This part of the form must be filled by an authorized law enforcement officer, as it involves verifying the vehicle against federal and state records.
  7. Failing to check the vehicle's VIN against the document accurately. It’s important that the VIN on the vehicle matches the VIN on the non-Kansas title or ownership document without any discrepancies.
  8. Not noting discrepancies in the "Remarks" section when the VIN on the vehicle and the ownership document do not match. Any differences must be clearly explained to ensure the integrity of the vehicle’s identification.
  9. Leaving the section about the title being branded (labeled) incomplete or incorrectly marked. This information is critical in identifying whether the vehicle has been previously damaged or considered a salvage.
  10. Overlooking possible additional requirements that may be necessary if discrepancies are found during the VIN verification process. Being proactive and inquiring about further documentation can save time and prevent processing issues.

By avoiding these common mistakes, the process of completing the Kansas TR-65 form can be smoother, ensuring quicker processing and fewer setbacks in getting a vehicle properly titled and registered in Kansas.

Documents used along the form

When completing the Kansas TR-65 form, it's often necessary to provide additional documentation, especially in contexts where vehicular ownership, history, or status is involved. These supporting documents help streamline the process, ensuring that all requirements set forth by the Kansas Department of Revenue and the Division of Vehicles are accurately met. Below is a list of documents commonly associated with the TR-65 form, each serving a specific purpose in the wider context of vehicle registration, titling, and verification in the state of Kansas.

  1. Motor Vehicle Examination Certificate (MVE-1 Form): Required for vehicles that need a VIN inspection. This certificate is often needed when a vehicle is brought into Kansas from another state.
  2. Application for Title and/or Registration (TR-212a): This form is used to apply for a Kansas title and/or vehicle registration, crucial for establishing legal ownership and the ability to operate the vehicle on public roads.
  3. Proof of Insurance: Verification of current insurance coverage is required for vehicle registration. This often includes a policy number and effective dates of coverage.
  4. Bill of Sale: This document provides proof of purchase and details the transaction between buyer and seller, often required for private sales.
  5. Odometer Disclosure Statement (TR-59): This form verifies the mileage of the vehicle at the time of sale and is required for most vehicle sales between private parties.
  6. (6) Lien Release: If the vehicle was previously financed, a lien release from the lender is necessary to show that the vehicle is free from any financial encumbrances. (7) Power of Attorney (TR-41): This allows a designated person to act on behalf of another in regards to vehicle transactions, useful if the owner cannot be present. (8) Military Affidavit (TR-60): This form is for active-duty military personnel and verifies their status, potentially qualifying for certain exceptions or requirements. (9) Out-of-State Title: When a vehicle with an out-of-state title is being registered in Kansas, the original title document is required, showing proof of ownership. (10) Driver's License: A valid driver’s license serves as identification for the owner during the title and registration process.

Ensuring that these documents are accurately completed and submitted alongside the TR-65 form can considerably smooth the process of registering and titling a vehicle in Kansas. Detailed and correct documentation is the foundation of a successful application, fulfilling all legal requirements and preventing potential delays. For any specific queries related to these forms and the overall process, contacting the Kansas Division of Vehicles directly is advised to obtain the most current and detailed information.

Similar forms

The Kansas TR-65 form is similar to the Motor Vehicle Examination Certificate (MVE-1 Form) used by the Kansas Highway Patrol. Both forms serve the purpose of VIN verification but are utilized under different circumstances. The TR-65 form is specifically designed for Kansas residents or businesses who need to verify the vehicle identification number (VIN) of a vehicle that is currently located out of state. This situation arises for a number of qualifying reasons, such as Kansas residents on active military duty stationed out-of-state or attending an out-of-state college or university. The Motor Vehicle Examination Certificate (MVE-1 Form), on the other hand, is required for vehicles that are physically present within Kansas and need to undergo a VIN inspection as part of the procedure for obtaining a Kansas title and registration. While both documents are pivotal in verifying the integrity of a vehicle’s identification number against the title or ownership document, the key difference lies in the geographical location of the vehicle at the time of verification.

Additionally, the TR-65 form shares similarities with out-of-state title applications that require a VIN inspection. Like the TR-65 form, these applications necessitate a verification of the vehicle’s VIN to ensure that it matches the VIN on the title or ownership documents issued by another jurisdiction. This step is crucial for preventing fraud and ensuring that the vehicle being titled or registered is the same as the vehicle described in the ownership documents. Out-of-state title applications with this requirement aim to establish a clear and lawful chain of ownership before a vehicle can be legally titled or registered in a new state. While the TR-65 form caters specifically to Kansas residents and businesses with vehicles outside of Kansas, the underlying objective of confirming vehicle identity through VIN verification is a commonly shared goal among different jurisdictions’ title application processes.

Dos and Don'ts

When working with the Kansas TR-65 Form, it's important to pay attention to both what you should and shouldn't do to ensure the process goes smoothly. Below are guidelines to assist in correctly filling out and submitting this form.

Do:

  1. Check the correct box indicating why the vehicle is located out of state. Include a clear explanation if required.
  2. Ensure all information is filled out completely and accurately in the Owner Declaration Section.
  3. Have the form completed by a law enforcement officer as required for VIN verification. This step cannot be skipped.
  4. Provide a valid and clear copy of the out-of-state title or ownership document that is free of any alterations, erasures, or whiteout.
  5. Double-check that the vehicle identification number (VIN) on the form matches the VIN on your vehicle and the title/ownership document.
  6. Sign and date the form where indicated to certify the information provided is true and correct.
  7. Include all supporting documents when submitting the form to the Kansas Division of Vehicles.
  8. Verify the document through a law enforcement officer who will check the vehicle against the Federal Stolen Vehicle File (NCIC).
  9. Contact the Kansas Division of Vehicles for any questions or clarification on additional requirements.

Don't:

  • Leave any sections incomplete. Failing to fill out certain parts of the form can result in processing delays.
  • Attempt to fill out the VIN verification section yourself. It must be completed by a qualified law enforcement officer.
  • Use whiteout or make alterations to the title or ownership documents. Any changes may void the document for VIN verification purposes.
  • Ignore discrepancies between the VIN on the vehicle, the title/ownership document, and the form. Any differences must be noted in the Remarks section by the examining officer.
  • Forget to check if the out-of-state title has been branded/labeled and accurately mark the appropriate box on the form.
  • Submit the form without first checking through NCIC for any stolen record as a law enforcement officer.
  • Assume the process is complete after submitting the form. Follow up with the Kansas Division of Vehicles to ensure all requirements have been met.
  • Operate or attempt to register the vehicle in Kansas without ensuring all discrepancies are resolved and the VIN verification is accepted.
  • Overlook the potential for additional requirements if discrepancies are found during the VIN verification process.

Misconceptions

When it comes to the Kansas TR-65 form, there are some common misconceptions that need clearing up. This form is a vital part of the vehicle titling and registration process for Kansas residents and businesses with vehicles located out-of-state. Let’s explore and clarify these misunderstandings.

  • Misconception #1: The TR-65 form is only for military personnel.

While active military duty stationed out-of-state is a qualifying reason to use the TR-65 form, it is also applicable for Kansas residents attending an out-of-state college, university or school, for Kansas apportioned registration applications, and for residents or businesses with vehicles temporarily out of Kansas.

  • Misconception #2: Any law enforcement officer nationwide can complete the VIN verification section.

The law enforcement officer completing the VIN verification must be able to examine the public VIN on the vehicle, compare it with the number on the title or ownership document, and certify no stolen record is found in the federal or state vehicle files (NCIC). While it doesn’t specify the officer must be from a specific state, the examination requires access to specific databases and adherence to the form’s standards.

  • Misconception #3: A vehicle can be registered in Kansas without any in-state inspection if you have a TR-65 form.

The TR-65 form allows out-of-state residents or businesses temporarily to bypass the need for a Motor Vehicle Examination Certificate (MVE-1 Form) until the vehicle returns to Kansas. However, if the vehicle is permanently returning to Kansas, an MVE-1 form must still be obtained and submitted for final registration.

  • Misconception #4: Electronic copies of titles or ownership documents are not accepted for VIN verification.

Contrary to this belief, a faxed copy of the front and back of the title from the lien holder or lessor is acceptable for the VIN verification process. This flexibility helps facilitate the process for out-of-state residents or businesses.

  • Misconception #5: The TR-65 form process is free of any fees.

While the form itself indicates no fee is collected by the State of Kansas for an out-of-state VIN verification using this form, there might still be incidental costs related to obtaining necessary documentation or certifications from law enforcement or other entities.

  • Misconception #6: Alterations on the TR-65 form are acceptable as long as the information is legible.

Any alterations or erasures on the TR-65 form will void it. It’s crucial that the information provided is accurate from the onset to avoid complications in the titling and registration process.

  • Misconception #7: The TR-65 form is a lengthy and complicated process.

While the form requires attention to detail, it is designed to streamline the verification and registration process for Kansas residents and businesses with vehicles out-of-state. Following instructions carefully can simplify the process.

  • Misconception #8: The Owner Declaration section is optional.

This section is mandatory and must be completed by the vehicle's owner. It includes critical information about the reason the vehicle is located out-of-state and certifies that the information provided is true and correct.

  • Misconception #9: The TR-65 form can be submitted electronically to the Kansas Department of Revenue.

While the form can be filled out electronically for ease, it must be physically submitted as it requires a law enforcement officer's signature and, in some instances, additional documentation that may not be transferable electronically.

  • Misconception #10: The TR-65 form eliminates the need for further vehicle inspection upon returning to Kansas.

The TR-65 form serves as a temporary measure for out-of-state vehicles. Upon returning to Kansas, a vehicle is generally required to undergo the standard vehicle inspection (MVE-1 Form) as part of the title and registration process, unless exempted under specific criteria.

Understanding these aspects of the TR-65 form can help Kansas residents and businesses navigate the process of titling and registering their out-of-state vehicles more smoothly and with confidence.

  • Part II – VIN Verification: The VIN verification section must be completed by a law enforcement officer. This section involves physically examining the vehicle and its title or ownership document to verify the authenticity of the Vehicle Identification Number (VIN) and to check for any potential tampering.
  • Checking the VIN through NCIC: All vehicle identification numbers documented in the verification process must be checked through the National Crime Information Center (NCIC) to ensure the vehicle is not stolen. Any discrepancies or stolen vehicle records found must be handled according to department policy.
  • Possible Additional Requirements: If discrepancies are discovered during the VIN verification process, further documentation may be requested by the State of Kansas. It's crucial to address any issues promptly to avoid delays in the title and registration process.
  • Contact Information for Questions: For any questions or concerns related to the TR-65 form or the out-of-state VIN verification process, the Kansas Division of Vehicles Titles and Registrations Bureau provides contact details, ensuring that applicants can seek assistance when needed.

Thoroughly understanding these key aspects will facilitate a smoother process for completing and submitting the Kansas TR-65 form, ultimately ensuring compliance with Kansas law and regulations regarding vehicle title and registration for residents and businesses temporarily located out of state.
